Worker status and IR35 Audit

The Government is cracking down on employment practices.

Big changes are due in April this year:

  • employers will have to issue all new employees with a written statement of employment particulars from day one;
  • employers will have to change the way they calculate holiday pay of certain workers to include the average remuneration in the previous 12 months;
  • all agency workers will have the right to the same pay as permanent staff once they have been engaged by the same employer in the same role for 12 weeks;
  • the much-publicised changes to ‘IR35’ are planned to be implemented – making medium and large businesses responsible for determining the tax status of contractors.

In addition, there have been a spate of court cases concerning companies incorrectly labelling people as self-employed contractors instead of being workers.
